a. If the extent of damage to people and property is not large, the provincial-level police department will guide the compensation for damage between the two parties and make a record of such compensation and must promptly notify the People’s Procuracy. same level. In case the two involved parties disagree on the level of compensation for damage, the police of the province or city shall transfer the file to the People’s Procuracy of the same level for study and handling according to the civil procedure order. The People’s Procuracy instituting civil cases shall transfer the files with necessary documents and evidences to the People’s Courts of the same level for civil trial.
b. The People’s Courts of provinces and cities will open a civil trial for traffic accidents that cause serious damage and are transferred by the People’s Procuracy of the same level after studying the conclusions. formally in writing. Their criminal liability (if any) will be considered separately by the Supreme People’s Procuracy.
c. The People’s Procuracy of provinces and cities shall examine for penal liability serious cases where lawbreakers are not entitled to immunity from criminal trial.
d. Criminal and civil prosecution and adjudication in Vietnam must comply with the principles of Vietnamese civil and criminal procedure. During the prosecution and trial process, the Procuracy and Court must ensure the procedural rights of the parties according to Vietnamese law.
– The People’s Procuracy must participate in the court hearings of the above cases in order to carry out the adjudication and adjudication according to the argument.
When the court has finished hearing the case, it must immediately hand over a copy of the written judgment to the involved parties so that they can use their right to appeal according to the law. The preparation of dossiers of international judicial mandate, the procedures for requesting handling must comply with the signed mutual legal and legal assistance agreements, if that country does not have signed agreements, it will be prepared in accordance with the provisions of law. proceedings in Vietnam, taking into account international judicial practice.”

Accordingly, if the driver of a diplomatic vehicle causing a traffic accident is entitled to immunity from trial, the dossier will be sent to the Ministry of Foreign Affairs so that it can be handled diplomatically.
